David A O'Toole

David A. O'Toole is a distinguished attorney at Bragança Law, with a rich background in litigation and regulatory enforcement. He spent 24 years as senior staff litigation counsel at the Federal Trade Commission's Midwest Region in Chicago. Before joining the FTC, David practiced law for nearly six years in Chicago and Washington, D.C., focusing on antitrust, white collar defense, and commercial litigation.

David is a three-time graduate of the University of Chicago, earning a B.A. in History (1984), an M.B.A. (1988), and a J.D. with honors (1992). At the FTC, he led initiatives against deceptive marketing practices, targeting companies involved in pyramid schemes and misleading consumer credit offerings. He notably led the first FTC case to shut down a debt collector through asset freezes and consumer restitution. Additionally, he pioneered FTC actions against telemarketers using robocalls for deceptive auto warranty sales.

In the realm of antitrust, David tackled price-fixing investigations and scrutinized mergers, particularly in the healthcare sector. His work often led to prosecutions by the USDOJ, with some defendants receiving lengthy sentences.

David has shared his expertise as an adjunct professor at Loyola University School of Law and the John Marshall Law School, teaching courses in Consumer Protection, Antitrust, and International Antitrust Law. He has also lectured at the University of Chicago Business School and Northwestern Law School, and provided training to law enforcement and consumer groups.
