Charles H. Montgomery

Charles H. Montgomery is a distinguished family law attorney practicing in Cary, North Carolina. His legal expertise encompasses equitable distribution of property, child custody, child support, alimony, and divorce. In addition to his more than thirty-five years in family law, Charles has substantial experience in commercial real property and business litigation.

Charles earned his law degree from Vanderbilt University in 1974 and graduated with honors from Duke University in 1971. He is admitted to practice in both state and federal courts, as well as before the U.S. Supreme Court.

Recognized for his legal acumen, Charles is listed in Marquis' "Who's Who in America" and "Who’s Who in American Law." He was named a “North Carolina Super Lawyer” in 2009, 2017, 2018, and 2019. His practice includes representing clients in complex interstate and international child custody and support cases, utilizing the Uniform Child-Custody Jurisdiction & Enforcement Act and the Uniform Interstate Family Support Act.

Charles' appellate experience is extensive, having appeared before the North Carolina Supreme Court and Court of Appeals. Notable cases include Boyles v. Boyles, addressing personal jurisdiction in an alimony and child support dispute between North Carolina and Florida, and Francis v. Francis, which involved intricate alimony issues.

Previously, Charles was a partner for a decade at the former firm Sanford, Adams, McCullough & Beard, led by Terry Sanford, a former U.S. Senator, Governor, and President of Duke University. He also contributed to his community by serving nine years on the Cary Town Council and the Wake County Board of Commissioners.
