Total Loss Valuation Dispute Letter
By Serdar Arslan, editor · Last reviewed · How we research
Use this letter when an insurer has declared your car a total loss and you believe the actual cash value it offered is too low. It asks for the complete valuation report and the documents behind any condition deduction, points out specific problems, lists your own comparable vehicles and receipts, and names a counter-offer. Putting it in writing gives you a record of what you asked for and when.
Before you write, run the numbers with our total loss offer checker so the problems and the counter-offer amount come from the report and your listings, not a guess. Attach printouts or screenshots of each comparable listing with the date you saved it, receipts for recent repairs or upgrades, and any photos that show the car's condition before the crash.
The last paragraph mentions the appraisal clause. That only applies to a claim under your own policy (collision or comprehensive). If you are claiming against the other driver's insurer, delete that paragraph; their policy's appraisal clause is not yours to invoke.

I do not accept this offer. I believe it is below what a comparable vehicle would have cost to buy in my area right before the loss. 1. Problems with the valuation [Problems you found in the valuation report] 2. Comparable vehicles I found [Your comparable vehicles (price, miles, distance, seller, date saved)] 3. Repairs and upgrades not reflected in the valuation [Recent repairs or upgrades with receipts] 4. Taxes and fees [Sales tax, title and registration fees (what you are asking for)] Based on this information, I ask that you revise the offer to [Your counter-offer amount]. Please also send me, in writing: a. The complete valuation report, including the source, location, mileage, options and listing date of each comparable vehicle. b. The inspection notes and photos supporting any condition adjustment. c. An explanation of any discount or adjustment applied to comparable asking prices. d. A breakdown of how the final amount was calculated. Please respond by [Requested response date]. If you disagree with any point, explain the reason and tell me what additional information you need. If we cannot agree on the value, please send me a copy of the appraisal provision in my policy. I may invoke it to resolve the disagreement over the amount of loss. Enclosures: [Enclosures] Sincerely, [Your full name]
Tips
- Ask for the full valuation report before you write. Some insurers send only a summary unless you ask.
- Pick comparables with the same trim and options and similar miles, listed close to you, and save each listing with the date.
- Name a specific counter-offer and show how you reached it. A number backed by listings is easier for an adjuster to approve than a general complaint.
- Delete the appraisal paragraph if the claim is against the other driver's insurer. The clause comes from your own policy.
- If you have a loan, do not let the dispute delay contact with your lender. Interest usually keeps running until the payoff is received.
- If the insurer does not respond or explain its decision, you can contact your state insurance department's consumer services unit.
Sending it and keeping proof
Keep a copy of everything you send. If a deadline or a response time matters, send letters by a method that gives you proof of delivery, such as certified mail with a return receipt, or email with a read receipt, and note the date in your claim file. Many insurers and agencies also accept uploads through an online portal, so save the confirmation screen or email.
